Ghana’s outgoing President, Nana Akufo-Addo, has received a petition requesting the removal of Chief Justice Gertrude Torkornoo from office. The petition, filed on December 17, 2024, accuses the Chief Justice of incompetence and misconduct.
According to the petitioner, Professor Stephen Kwaku Asare, the Chief Justice’s actions have undermined the integrity of the judiciary. The petition cites Article 146 of Ghana’s Constitution, which outlines the grounds for removing a Chief Justice, including stated misbehavior or incompetence.
The petition alleges that the Chief Justice has engaged in unconstitutional behavior, including directly requesting the appointment of specific judges to the Supreme Court. This action allegedly bypassed the Judicial Council’s mandate and contravened the constitutional process.
The Chief Justice has also been accused of arbitrarily reconstituting judicial panels and transferring judges, which could compromise the impartiality and independence of the judiciary.
The petition has sparked concerns about the integrity of Ghana’s judiciary and the potential implications for the country’s democratic institutions.
